These Terms of Service ("Terms") are an agreement between you and Absurde Software (ABN 32 238 728 072), an Australian business based in Queensland, Australia ("Absurde", "we", "us" or "our").
They apply to everything we provide, including our website at ../index.html, our software-as-a-service products (such as Flow CRM), our mobile apps, and our custom software and professional services (together, the "Services"). Every Absurde product links to these Terms, and they apply to current and future products.
Some products have extra terms, which are set out in the "Product-specific terms" sections at the end of this page. Custom software projects are also governed by the proposal or statement of work we agree with you.
By accessing or using the Services, creating an account, or paying for a Subscription, you agree to these Terms. If you do not agree, please do not use the Services.
Nothing in these Terms limits any rights you have under the Australian Consumer Law. See the "Australian Consumer Law" section below.
These Terms apply to you whether you use the Services yourself or on behalf of an organisation. If you accept these Terms on behalf of an organisation, "you" includes that organisation, and you confirm that you have authority to bind it.
If documents conflict, they apply in this order (the earlier document prevails):
Our Privacy Policy (../privacy-policy/index.html) explains how we handle personal information and forms part of these Terms.
We provide:
Each product's features, limits and pricing are described on that product's website or in its app, or are shown to you at checkout.
You are responsible for checking that the Services suit your needs and for complying with the laws that apply to your use of them, including in your country.
You must be at least 18 years old to create an Account or buy anything from us. Our products are not directed at children.
You must give us accurate information when you register, and keep it up to date.
You are responsible for keeping your login credentials secure and for activity that happens under your Account. Tell us promptly at if you think your Account has been accessed without permission.
Where a product supports Organisations, the people your Organisation makes administrators can invite, manage and remove users, change plans and billing, and access, export or delete the Organisation's Customer Data. Each user's access depends on their Organisation's Account being in good standing.
You must use the Services lawfully and in line with these Terms. You must not, and must not allow anyone else to:
If we reasonably believe you have breached this section, we may remove the content concerned or suspend your access, as described in the "Suspension and termination" section.
You keep all of your rights in your Customer Data. We do not claim ownership of it.
You give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transmit and display your Customer Data, but only as needed to provide, secure, support and maintain the Services for you, and to comply with the law. This licence ends when the Customer Data is deleted from the Services, except for copies in backups, which are deleted in the ordinary course.
We do not sell your Customer Data, and we do not use it to advertise to you or to anyone else.
We may produce aggregated or de-identified information about how the Services are used, such as feature usage and performance metrics, and use it to operate and improve the Services. That information will not identify you, your users or the people in your Customer Data.
You are responsible for your Customer Data and for how you collect it. That includes:
When we handle personal information in Customer Data, we do so on your behalf and on your instructions, as described in our Privacy Policy.
If you send us feedback, suggestions or ideas, we may use them freely to improve our products. We have no obligation to you for doing so.
We, or our licensors, own all intellectual property rights in the Services. That includes our software, source code, designs, interfaces, documentation, trade marks, logos and content, but not your Customer Data or Deliverables we have assigned to you.
While you comply with these Terms and pay any applicable Fees, we give you a limited, non-exclusive, non-transferable licence to use the Services for your own personal or internal business purposes. We reserve all rights that these Terms do not expressly give you.
Prices are in Australian dollars (AUD) and exclude GST unless we say otherwise. GST and any other applicable taxes are added at checkout or on your invoice. We issue tax invoices for taxable supplies.
If you are outside Australia, checkout may show and charge the price in your local currency, using our payment processor's exchange rate at the time. Subscriptions and invoices stay in AUD. Your bank or card issuer may charge currency conversion or international transaction fees, and those fees are your responsibility.
Payments are processed by our payment provider, Stripe. You agree to give accurate billing details and to keep a valid payment method on file while you have an active Subscription. Your card details are handled by Stripe and are not stored by us.
By buying a Subscription, you authorise us (through Stripe) to charge your payment method:
Subscriptions are billed in advance, monthly or yearly depending on the plan you choose. They renew automatically for the same period unless cancelled before the renewal date.
If you add seats, move to a higher plan or switch from monthly to annual billing, you are charged straight away for the prorated cost of the change for the rest of the current billing period.
If you remove seats, move to a lower plan or switch from annual to monthly billing, the change applies straight away. The unused value is added to your account as credit and applied automatically to your later invoices.
If a payment fails, we or Stripe may retry it, and we will let you know. If the payment is still outstanding 14 days after we notify you, we may suspend access to paid features until it is paid. Your Customer Data is not deleted because of a suspension.
We may change our prices. We will give you at least 30 days' notice of a price increase for an existing Subscription. The new price applies from your next renewal after the notice period. If you do not want to continue at the new price, you can cancel before the change takes effect.
If we make an obvious pricing error, we may correct it. If we have already charged you the wrong amount, we will refund any overcharge, or give you the option to cancel and receive a full refund.
You can cancel a Subscription at any time from your Account's billing settings, or by contacting us. Cancellation takes effect at the end of the current billing period, and you keep access until then. We do not charge cancellation fees.
Fees already paid for the current billing period are not refunded when you cancel, except where these Terms or the law say otherwise.
Account credit (for example, from removing seats or switching from annual to monthly billing) stays on your account and is applied to later invoices. If you would prefer a cash refund of your credit balance, contact us at and we will refund it to your original payment method.
We will also give a refund where:
Refunds are made to the original payment method, in the currency of the original charge where possible. Exchange rate movements may mean the amount you receive differs slightly from what you paid.
Some products include features powered by artificial intelligence or machine learning ("AI Features"), such as generating, summarising or suggesting content.
To provide AI Features, we send the relevant input (which may include Customer Data) to third-party AI model providers who process it on our behalf. We use these providers only under commercial terms that do not allow them to use your input or output to train their models.
AI output can be inaccurate, incomplete or inappropriate, and similar inputs may produce similar outputs for other users. You are responsible for reviewing output before you rely on it, publish it or use it to make decisions about people. Do not use AI output as a substitute for professional legal, financial, medical or other advice.
Between you and us, you own the output generated from your input, to the extent the law allows.
Where a product lets you switch AI Features off, you can choose not to use them.
Our mobile apps are licensed to you, not sold. The app marketplace's own terms and usage rules also apply to your download and use of an app. In-app purchases and subscriptions bought through a marketplace are billed, renewed, cancelled and refunded by that marketplace under its policies.
If you downloaded an app from the Apple App Store:
Questions, complaints or claims about an app can be sent to us at .
This section applies when we design, build, maintain or consult on software for you. The scope, timeline, Fees and payment schedule for each engagement are set out in a proposal, quote or statement of work ("Proposal"). If a Proposal conflicts with this section, the Proposal prevails.
You agree to give us timely access to the information, materials, decisions, systems and people we reasonably need. If delays or changes on your side affect the timeline or cost, we will tell you and agree an adjustment with you.
Changes to the agreed scope are handled as variations. We will confirm the effect of a variation on cost and timing in writing before we carry it out.
Unless the Proposal says otherwise, invoices are payable within 14 days of issue. Where fees are overdue, we may pause work on reasonable notice until they are paid.
Once you have paid the Fees for a Deliverable in full, you own the intellectual property in that Deliverable, except for the items listed in the next paragraph.
We keep ownership of:
Where Absurde Materials are included in a Deliverable, we give you a perpetual, non-exclusive, royalty-free licence to use, modify and maintain them as part of that Deliverable.
Deliverables may include open-source software and Third-Party Services, which are licensed under their own terms.
Acceptance testing and any defect-fix period are described in the Proposal. Unless the Proposal says otherwise, we will fix, at no extra cost, defects that you report within 30 days of delivery and that are caused by our failure to meet the agreed specification.
Ongoing hosting, maintenance and support are not included unless the Proposal or a separate support agreement says they are.
We may name you as a client and describe the work in general terms in our portfolio and marketing, unless you ask us not to. We will never disclose your confidential information in doing so.
The Services rely on, and may let you connect to, Third-Party Services. Examples include payment processing, sign-in providers, email delivery, calendars and other integrations you choose to enable.
Third-Party Services are governed by their own terms and privacy policies. We are not responsible for them, and they may change or become unavailable. If you connect a Third-Party Service, you authorise us to exchange data with it as needed for the integration to work.
We work to keep the Services available and reliable. However, unless we have agreed a service level with you in writing, we do not guarantee that they will be uninterrupted or error-free. Downtime can happen because of maintenance, emergency repairs, failures of hosting or third-party infrastructure, attacks, and other events outside our reasonable control. Where we can, we schedule maintenance to minimise disruption.
Support is provided by email at and through any other channels described for each product.
We continually improve our products and may add, change or remove features. If we make a change that materially reduces the core functionality of a paid product you subscribe to, we will give you reasonable notice. If you cancel because of the change, you are entitled to a pro rata refund of prepaid Fees for the unused part of your billing period.
We may discontinue a product. If we do, we will give paying customers at least 60 days' notice where reasonably possible, give you an opportunity to export your Customer Data, and refund any prepaid Fees for the period after the product ends.
You can stop using the Services and cancel your Subscription at any time, as described in the "Cancellation, refunds and account credit" section.
We may suspend or terminate your access to the Services if:
Where it is safe and lawful, we will tell you why, and we will restore access once the issue is resolved.
We may also end a Subscription for our convenience by giving you at least 30 days' notice. In that case we will refund prepaid Fees for the unused part of your billing period.
If your Account is terminated for a serious breach, you may not create a new Account without our permission.
You can export your Customer Data using the tools a product provides at any time while your Subscription is active.
After a Subscription ends, we keep your Customer Data for at least 30 days so that you can reactivate or ask us to help export it. After that we may permanently delete it, unless the law requires us to keep it. Copies in backups are deleted in the ordinary course of our backup cycle.
We take reasonable steps to back up the Services. However, you are responsible for keeping your own copies of any Customer Data you need for legal, regulatory or business reasons.
We handle personal information in line with the Privacy Act 1988 (Cth) and our Privacy Policy at ../privacy-policy/index.html. The Privacy Policy explains what we collect, how we use it, who we share it with and how you can access or correct it.
Each of us may receive confidential information from the other, such as business plans, technical information, credentials, pricing and Customer Data. The party receiving it must keep it confidential and use it only to perform or receive the Services. It may be disclosed only to employees, contractors and advisers who need to know it and are bound by similar obligations, or where the law requires.
This obligation does not apply to information that is or becomes public through no fault of the receiving party, or that the receiving party already had or developed independently.
Our Services come with guarantees that cannot be excluded under the Australian Consumer Law ("ACL"). Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the ACL or any other law that cannot lawfully be excluded, restricted or modified.
If the Services are not of a kind ordinarily acquired for personal, domestic or household use, then, to the extent the law allows, our liability for failing to comply with a consumer guarantee is limited, at our option, to supplying the Services again or paying the cost of having them supplied again.
Subject to the "Australian Consumer Law" section and to any promise made expressly in these Terms or a Proposal, the Services are provided "as is" and "as available". To the extent the law allows, we exclude all implied warranties and conditions, including that the Services will meet your particular requirements, be uninterrupted, or be free from errors.
Information on our website and in our documentation is general information only and is not professional advice.
This section applies to the extent the law allows, and subject to the "Australian Consumer Law" section.
Neither of us is liable to the other for any indirect or consequential loss, or for loss of profits, revenue, goodwill or anticipated savings, however it arises.
Our total liability arising out of or in connection with the Services or these Terms is limited to the greater of:
Each party's liability is reduced to the extent the other party, or a Third-Party Service the other party chose to use, caused or contributed to the loss.
These limits do not apply to liability for fraud, wilful misconduct, personal injury or death, or to liability that cannot be limited by law.
You indemnify us against third-party claims, and against the reasonable costs, losses and liabilities arising from them, to the extent they are caused by:
This indemnity is reduced to the extent that we caused or contributed to the claim. We will notify you promptly of any claim, and we will not settle it in a way that imposes obligations on you without your consent.
If you believe content available through the Services infringes your copyright or other intellectual property rights, please email with:
We will review notices promptly and may remove or disable access to material. Where appropriate, we will contact the customer responsible for it.
You agree that we may give you notices, invoices, receipts and other communications electronically, by email to the address on your Account or through the Services. For the purposes of the Electronic Transactions Act 1999 (Cth), these communications satisfy any requirement for them to be in writing.
We will only send you marketing emails in line with the Spam Act 2003 (Cth), and every marketing email will include a way to unsubscribe. You will still receive service and billing messages while you have an Account.
Neither of us is liable for a failure or delay in performing obligations, other than an obligation to pay money, caused by events beyond its reasonable control. Examples include natural disasters, pandemics, war, terrorism, government action, industrial action, failures of the internet, power or telecommunications, hosting provider outages, and cyber attacks.
The affected party must take reasonable steps to minimise the effect of the event and resume performance as soon as practicable.
We may update these Terms as our products, the law or our business change. The "Last updated" date at the top of this page shows when they last changed.
If a change materially and adversely affects you, we will give you at least 30 days' notice, by email to your Account address or through the Services, before it takes effect. If you do not agree to the change, you can cancel before it takes effect. If you cancel because of the change, you are entitled to a pro rata refund of prepaid Fees for the unused part of your billing period.
Other changes, such as clarifications, new products, or changes required by law, take effect when we publish them.
If you keep using the Services after a change takes effect, you accept the updated Terms.
If you have a complaint or dispute, please contact us first at . We will try to resolve it with you in good faith within 30 days.
If it is not resolved, either of us may propose mediation before starting court proceedings. This does not stop either of us seeking urgent relief from a court, and it does not affect your right to contact a consumer protection regulator, such as the ACCC or your state or territory fair trading agency.
These Terms are governed by the laws of Queensland, Australia. Each of us submits to the non-exclusive jurisdiction of the courts of Queensland and the courts that can hear appeals from them.
If you are a consumer outside Australia, you may also have rights under the mandatory laws of your country, and these Terms do not take those rights away.
If you have questions or complaints about these Terms or the Services, contact us:

These terms apply to Flow CRM (https://flow-crm.app) in addition to the general Terms above. If they conflict with the general Terms, these terms prevail.
Flow CRM is billed per seat. Plans are A$20 per seat per month or A$200 per seat per year. Prices exclude GST, which is added at checkout. A seat is one user in your Organisation. The current prices are always shown in the app and at checkout before you pay.
Seat and plan changes are made in the billing portal and follow the "Changes during a billing period" part of the "Fees, billing and payment" section:
Cancelling a Flow CRM Subscription takes effect at the end of the current billing period. Your Organisation keeps access until then.
Flow CRM lets you collect information from your own clients through forms and workflows. You are responsible for telling them how you will handle their information and for having any consents you need. We process that information on your behalf, as described in the "Your data" section and in our Privacy Policy.
